The Area Of Operation Of The Makhanlal Vyas Vidhyapeeth Shall Be All Over India Level And According To Decided And Applied Rules And Laws Of Government Of India Trusts / Societies / Ngos / Organisations.

The Board Of Makhanlal Vyas Vidhyapeeth Shall Have The Power To Make And Alter Or Amend The Rules And Regulations With Regard To The Better Conduct Of The Affairs Of The Trust With The Approval Of The Board Of Trustees.

In All Matters Related To The Associations , Organisations , Councils , Committees , Networks , Forums And Groups Formed And Other Matters The Decisions Of Board Of Trust Of The Makhanlal Vyas Vidhyapeeth Shall Be Final And Can Not Challanged At Any Level , As The Associations , Organisations , Councils , Committees , Networks , Forums And Groups And Their Appointed / Selected Members Will Be Members , Associates And Affiliates By Accepting The Terms And Conditions To Become Appointed / Selected Members , Associates And Affiliates With Any Of The Committees Or Sub Committees Of The Trust In Any Decided From Or Pattern.

The Provision Of Indian Trust Act 1882 Shall Apply To Only Those Matters Specifically Mentioned In These Presents. Furthermore , If The Board Of Trustees Makes By Laws , Rules And Provision Then The Provision Of Above Mentioned Act Shall Not Contravene And Override The Consecutive Provisions Of Trust.

MAKHANLAL VYAS VIDHYAPEETH for Open and Distance Learning is an autonomous council, which is established for development of education under the guidelines of National Education Policy 1986, Govt. of India and programme of action 1992, Govt. of India.

Under Human Right Protection Act 1993 autonomous bodies have been given Special Consideration. (for further details refer air 1993 Sc 2178).

MAKHANLAL VYAS VIDHYAPEETH for Open and Distance Learning is an Autonomous Council and all educational institutions are governed by the Rules framed by Government of India and each educational organization is having discretionary powers. According these powers every Institution/ Board / University / State Govts. / Central Government of India is having the liberty and right to take own decision either to allow or refuse any admission / service. But we give our best to promote the non-formal education programmes, which are autonomous education programmes of MAKHANLAL VYAS VIDHYAPEETH for Open and Distance Learning. The Legality, Validity and Utility of our education programmes is in strict conformity with the constitution of India and law of the land under Article 19(1)G, 29 & 30.

According to the Ministry of Human Affairs. Govt. of India Notification No. 26/4/52 CC Dated. 20.09.1952 issued in consultation. with the union public service commission that in the case of Degree /Diploma awarded by Board/University in India which are incorporated by an act of central of Part B state legislature in India. No formal orders of recognition for such Degree/ Diploma needed to be issued by Government. Such Degree should be Recognized Automatically for the Purpose of employment

Viewed at from the fulfilment of provisions of the articles 14, 19(1), 21, 29, 30, 45, 46 344 & 351 of the Indian Constitution 1950, the work done by MAKHANLAL VYAS VIDHYAPEETH (MLVV) is a valid one for appreciation. The concept of Distance Education originated from Berlin (Germany) in 1856. Afterwards, Russia granted recognition to distance education in the world. In this manner the idea of Open Universities was conceived by the British Prime Minister Mr. Harold Wilson in the year 1863 to provide an opportunity to persons who were otherwise denied opportunities to further their education and make their life successful. In 1969 under the Royal Charter an Open University was established the success of which was more far reaching than the traditional Universities. Under the new Education Policy 1986, the Government of India laid particular stress on Open Universities and Distance Education. MAKHANLAL VYAS VIDHYAPEETH (MLVV). is getting necessary direction and full co-operation from Educationists, Professors, Philanthropists, Social Workers, Corporate Managers of MNCs of our country. It is their unanimous opinion that MAKHANLAL VYAS VIDHYAPEETH (MLVV) has given practical shape to the concept of British Prime Minister Harold Wilson by providing Open and Distance Education to the under privileged sections of students and encouraging students for learning in depth. Under Human Rights Protection Act, 1993, autonomous bodies like the MAKHANLAL VYAS VIDHYAPEETH (MLVV) have been given special protection. For further details please see AIR 1993 SC 217B.

All Educational Boards / Universities are autonomous bodies. It is left to the discretion of university either to allow or refuse admission to a student from another university. In this way every State Government is at liberty whether to provide service to person who has passed out from a particular university or educational council or not Regarding the question of recognition MAKHANLAL VYAS VIDHYAPEETH (MLVV) is an ISO certified Council which is registered under Planning Commission, Govt of of India.

MAKHANLAL VYAS VIDHYAPEETH (MLVV) for Open and Distance Learning is not in receipt of any grant-in-aid either from the Government or from the UGC, so far. Therefore NCTE, AICTE, UGC Act is not applicable to National Open University. Under Human Rights Protection Act, 1993, autonomous bodies like the MJBPEDU have been given specific protection. Schools, Colleges, Universities, Organisations, Bodies, Authorities for all the education, learning and benefit of learners, career seekers, needy students, needy persons and for general public.

2. To open, found, promote, set-up, run, manage, maintain, assist, finance, acquire, take over, establish Colleges, Universities, Educational centres to provide Degree, Diploma, Certification, Training, research programme and all kind of courses.

3. To open, found, promote, set-up, run, manage, maintain, assist, finance, acquire, take over, establish Colleges, Universities, Educational centres to provide Degree, Diploma, Certification, Training, research programme and all kind of courses for Law, Languages; as Bachelor and Master Degree, Diploma in Law i.e. LLB, LLM, DLL, Language Courses in Hindi, Sanskrit and all other academic and professional courses and degrees related to law.

4. To open, found, promote, set-up, run, manage, maintain, assist, finance, acquire, take over and establish Colleges, Universities, Educational centres to provide Degree, Diploma, Certification, Training, research programme and all kind of courses for Education; as Bachelor and Master Degree, Diploma in Education i.e. B.Ed., M.Ed., and all other academic and professional courses and degrees related to Education and Teaching. To open, found, promote, set-up, run, manage, maintain, assist, finance, acquire, take over and establish the Degrees, Diplomas and Certification cources of/in/for/with Bachelor of Education (B.Ed.) or its equivalent, Master of Education (M.Ed.) or its equivalent, Bachelor of Elementary Education (B.El.Ed.), Degree and Diploma Courses in Nursery Teachers Training, Bachelor of Physical Education (B.P.Ed.), M.P.E., M.P.Ed., Certificate in Physical Education (C.P.Ed.), M.Sc.Ed. course or an equivalent course, National Council for Teacher Education (NCTE) Courses and Degrees, B.A.B.Ed., B.Sc. To open, found, promote, set-up, run, manage, maintain, assist, finance, acquire, take over, establish Colleges, Universities, Educational centres to provide Degree, Diploma, Certification, Training, research programme and all kind of Degrees, Diplomas, Certificates and Courses related to Ayurved, Yoga, Unani, Naturopathy, Siddha, Homeopathy, AYUSH, including Academic, Medicine and Surgery.

To open, found, promote, set-up, run, manage, maintain, assist, finance, acquire, take over, establish Colleges, Educational centres to provide Degree, Diploma, Certification, Training, research programme and all kind of courses related to all kind of vocational sectors that promote, develop and improve the vocational knowledge and skills including Industrial Training Institutes (ITI) Course. 7.To run, setup, organise and manage Diploma in Community Medical Services (CMS) & Essential Drug (ED) and provide Degree, Diploma and Certificate in the Courses. 8.To open, found, promote, set-up, run, manage, maintain, assist, finance, acquire, take over, establish Colleges, Educational centres to provide Degree, Diploma, Certification, Training and research programme related to Information Technology, Computer, Modern Technology and Innovative technology sectors.

9.To establish, run, support and grant aid or other financial and technical assistance to other institutions, organisations, bodies working for and with similar aims and objectives for the development and advancement of education and diffusion of knowledge amongst the public.

10. To promote and to develop vocational education in the educational institutions leading to selfemployment and better employment opportunities.

11. To institutionalise the imparting, encouragement and dissemination of knowledge by way organising and supporting education programmes, symposia, workshops, seminars, conferences, exhibitions, lectures, demonstrations, activity focused camps and fairs, and all such related activities.

12. To establish, manage, run and support hostels and/or residential facilities/places for students, scholars, needy persons, women, old aged persons, adolescent girls, children and physically challenged persons.

13. To establish run, establish, operate and manage resident hostels and resident schools, resident colleges, resident institutions, resident universities and other residential organisations/centres.

14. To conduct non-formal educational programs in the form of group discussions, dramas and documentaries and films in rural India.

15. To operate, run, support, manage training centres, training institutes, coaching centres, coaching institutes, employment centres, educational institutes and other operations, campaigns, activities and programmes related to training, provide education, provide skills. develop skills, improve knowledge and make capable to get required employment and income generation activities and programmes.

16. To start, setup, run, operate, manage, undertake the institutions, schools, colleges, universities, educational, teaching and learning bodies individually by the trust at own level and/or with other organisations, universities, societies, non-governmental organisations, authorised bodies and with support of governmental and non-governmental bodies and organisations.

17. To conduct educational fairs, workshops, seminars and shows for providing career counselling and to provide guidance at trust level and on behalf of other institutions and with their support. 3.2 Health Facilities, Infrastructures and programmes.

To open, found, establish, promote, set-up, run, maintain, assist, finance, support and/or aid or help in the setting up and/or maintaining and/or running Medical, Health and all kind of Hospitals, Charitable Dispensaries, Maternity Homes, Clinics, Child welfare centres, Treatment centres, Research centres and Diagnostic centres related to Medical and Health System and Practices.

2. To open, found, start, promote, set-up, run, maintain, establish Hospitals, Charitable Dispensaries, Maternity Homes, Clinics, Treatment centers, Research centres and Diagnostic centres for Ayurved, Yoga, Unani, Naturopathy, Siddha, Homeopathy, Alternative Health System and Therapies, Traditional Health Systems, Traditional Therapies and all sectors related to AYUSH.

3. To form a integrated system of treatment, consisting mainly of the techniques of Medical and Health for Surgery and Emergency cases, Allopathy, Homeopathy, Ayurveda, Unani, Siddha, Yoga, Alternative Health System and Therapies, Traditional Health Systems, Traditional Therapies and Acupressure to soothe patients suffering from unbearable pains and rid them of disease.

4. To provide Health Care, Medical and Treatment to the society and needy people.

5. To manufacture and supply good quality medicines to various Government and Non-Government Hospitals, Dispensaries and Rehabilitation institutions of the state.

6. To construct the building and infrastructure etc. for boarding and lodging for those who are interested in Medical and Health practices, Health care, treatment and training.

7. To organise camps, seminars, conferences, meetings for Medical and Health in order to propagate the Medical and Health Systems and related awareness.

8. To prepare system and to sale and purchase of the medicines for the charitable hospitals.

9. To promote and develop better health and sanitation practices for the overall good of the society.

10. Create mass awareness and educate people to stop AIDS, Cancer and other diseases and undertake various programmes for prevention of AIDS, Cancer and other diseases.

11. To run, manage, setup and establish Drug Awareness and Counseling Centres.

12. To organise awareness and other programmes to control and eradicate the use of alcohol, tobacco,drugs and other harmful materials.

13. To organise De-addiction Camps and programmes.

3.3 Child rights and Child development.

1. To reach out to homeless street children without any form of support, in order to understand and analyse their life situation, socio-economic, psychological and emotional needs.

2. To provide opportunities for basic services, such as, education, nutrition, skill training, employment, recreation, counselling, etc., for the healthy growth and development of rural children, street and working children, especially children of weaker.

3. To undertake child development programmes including creative and learning programming.

4. To run and establish child development homes, shelters and other programmes.

5. To run, undertake, manage and initiate programmes for development and welfare of Children.

3.4 Empowerment of Women.

1. To undertake, manage and initiate programmes for Empowerment of Women.

2. To empower women of different cultures to improve their skills in information sharing, imparting skills, solidarity action and networking, and to enable women to deliberate together and work towards building a culture of peace.

3. To help and support by Training, Skill Development Programmes and courses to women and needy persons in Beauty therapists, Make up makers, Embroidery, Designing, Fashion Designing, Tailoring, Stitching, Weaving, Knitting, lacing and sowing of Fabric items, Mehandi, Soft Toys, Painting, Handicraft work and related sector to provide benefits and services for beneficiaries, members, related persons, professional and work solutions, training opportunities and much more.

4. To provide social justice for women through education and awareness.

5. To help the women and girls in all possible ways in order to make them self-reliant and self supportive and form Self help groups and a federation of Self help groups of the women.

6. To work for the socio-economic upliftment of women. To undertake activities for women empowerment and upliftment with the aim to make them self reliant and independent.

7. To act as an instrument of socio-economic change and development through the provision of financial and social development services for the development of women

8. To setup and rum Gims, swimming pools and health clubs for women.

9. To work for child development programmes, to reduce infant mortality rates, to eradicate malnutrition in children and to educate rural masses to invest and care for their girl children.

10. To undertake and run development programmes for girl children and adolescent girls.

11. To undertake programme to save the girl children and undertake measures and activities to curb female foeticide.

12. To support widow women and help them in better survival and make their better living standard.

13. To run and manage stay homes and ashram for widow women.

3.5 Welfare and empowerment of Persons with Disability (Divyang Jan).

1. To run, setup, establish, manage and develop institutions, schools, educational centres for the physically handicapped and disabled or mentally retarded persons (Divyang Jan).

2. To run, open, setup and establish Residential places, Hostels, Rehabilitation Centres, Residence cum Educational Centres for persons with Multiple Disability, physically challenged and disabled persons or mentally retarded persons (Divyang Jan) to provide and avail them health benefit, nutrition, food, clothing with living and survival improvement facilities.

3. To provide better opportunities for the physically challenged (Divyang Jan) with the aim to work for their rehabilitation to make them self-reliant and independent.

4. To work for Special Children with Multiple Disability, Mental Retardation, Autism, Slow Learning, deaf and dumb, Borderline Functioning, Multiple Disabilities, Cerebral Palsy and Down Syndrome. To establish education centres, School cum residential centres, help and support centres for such persons with Multiple Disability.

5. To run and establish Special Schools for children and persons with Multiple Disability like Slow learning, Autism, Behaviour Problems, Phobias, Speech problem, Poor Academic performance and Aggression for imparting special education to them. To teach and train persons with Multiple Disability (Divyang Jan) to promote their pre-vocational training and Skills. To provide vocational training to improve skill of persons with Multiple Disability (Divyang Jan).

6. To enable and empower persons with physical and mental disability to live as independently and as fully as possible within and as close to the community to which they belong.

7. To undertake programmes to enhance the social and living status of the disabled persons.

3.6 Natural Resource Management, Agriculture and farming system.

1. To undertake activities for the development of agricultural and farming sector of the country.

2. To work for implementation of advanced agricultural process and practises which thrushes to organic agro, horticulture, floriculture and fish culture productions.

3. To undertake, implement projects and programmes for agricultural development and natural resources management.

4. To accept and give financial grants, help and coordinate participation of social partners, employers in the private sector, training providers, professional societies and NGOs/civil society groups in the process of agricultural and other farming development.

5. To provide, undertake, manage and run irrigation facilities to improve agriculture and agricultural projects with the help of local communities, support agencies and government.

3.7 Information and Communication Technology and Computer Technology Programmes.

1. To create, run, develop and manage Information Technology and other technology related programmes, projects and works by software development and other required technology, tools and resources for Government, Government Agencies, social organisations and general public.

2. To work and arrange different activities and programmes for the development of computer education and information technology.

3. To collaborate with Government ministries and departments to utilise, manage, improve, implement and elaborate Information Technology, computer and mobile technology.

4. To run, establish, promote, set up, maintain, assist, support and/or aid and help in the setting up the different kinds of programmes/projects on information technology and computer education.

5. To run, manage, setup, undertake and get approval and accreditation of information technology and internet technology related skill development, training, learning course programmes and projects from departments, ministries, boards, and government monitored/authorised sectors and bodies for the skill development of the needy persons of rural areas as well as semi urban and urban areas.

6. To undertake and get accreditation for rural information Technology development and skill development programmes and projects.

3.8 Livelihood Upliftment, Skill Development and Employment Generation.

1. To Create and improve livelihood opportunities for Tribal Communities, youth, women and needy persons.

2. To Create marketing and other employment opportunities by various means for youth and needy people for upliftment of their living standards and improve income generation opportunities.

3. To create, run, setup various option, opportunities and infrastructures for income generation and livelihood and improvement of living standards of life for various persons of society.

4. To create, run and setup various programmes and projects for sustainable employment, livelihood and income generation opportunities and options.

5. To run and undertake programmes and schemes for unemployed and under-employed persons both in all sectors including skilled, semiskilled and unskilled for creation of wage and self-employment.

3.9 Microcredit, Micro-Finance and Self Help Groups.

1. To run, manage, setup, support and undertake microcredit and microfinance proprammes, projects and activities for rural development, urban development and social development, so economically poor persons can gain financial and social strength.

2. To form, run, manage, setup, support and undertake Self Help Groups (SHGs) in rural and urban areas under microcredit and microfinance schemes and programmes of the Trust.

3. To get and receive funds and donations from the supporters, groups, companies, banks, financial institutions, funding agencies, government departments, government ministries for the purpose of the Trust objects, programmes, projects and activities.

4. To run, setup, undertake and support microcredit and microfinance projects and programmes to provide small loans and credit to people.

5. To Organise training Programmes for Self Help Groups (SHGs) to improve microcredit and microfinance activities and objectives of the Self Help Groups (SHGs) according to Government. of India microfinance parameters and pattern.

6. To support according to the legal parameters to the Self Help Groups (SHGs) to get their better status and conditions.

7. To run, support and undertake manufacturing and provide service for the schemes of according to the Self Help Groups (SHGs) and other groups and organisations for the welfare of the society and improvement of social and economical status of needy people of society.

8. To work and run programmes to run, undertake, manage and setup such schemes and projects for social welfare and economical upliftment and livelihood of needy persons and groups of societ

9. To work as a Micro Finance Institution as per Global and parameters of Government of India given under the Government Financial Services.

10. To run, manage, setup, support and undertake microcredit and microfinance proprammes, projects and activities for rural development, urban development and social development, so economically poor persons can gain finanacial and social strength.

3.10 General Social Development and Social Welfare Objectives.

1. To manage, undertake and run programmes, projects and activities for poor people for their development and welfare.

2. To run, establish and open Computer Centres and Information Technology knowledge centres and Training Centres in all over India.

3. To create, run, develop and manage Information Technology and other technology related programmes, projects and works by software development and other required technology, tools and resources for Government, Government Agencies, social organisations and general public.

4. To work and arrange different activities and programmes for the development of computer education and information technology.

5. To Create and improve livelihood opportunities for youth, women and needy persons

6. To organise joint Marriage programmes and support girls in marriage.

7. To undertake and run capacity building programmes for the economic and social improvement of communities focussing youth.

8. To plan, run, setup, manage, help and undertake research programmes, activities, projects, work and initiatives for research and development related to any of the Trust objectives or other objectives for the welfare of human being which the trustees may decide from time to time.

9. To promote and establish anybody having objectives altogether or in part similar to any of the objectives set out above and to sponsor or otherwise support activities of any such body insofar as the same shall be incidental or conducive to any of the objectives set out above.

10. To build partnerships and networks of stakeholders to support and strengthen community, NGOs, enterprises, corporations and state capacities to address development problems.

11. To promote cooperation with various agencies and institutions, regional and national organisations to conduct other activities for the realisation of the purpose of this trust.

12. To form and constitute forums, committees, groups, action groups to generate awareness regarding public interest issues and government development programmes.

13. To promote activities for total development, viz. social, economic, educational, medical and cultural fields especially in the rural areas or in urban areas with a particular interest in the downtrodden and economically weaker sections.

14. To organise social, cultural and welfare events, programmes, activities and work for the social awareness, cultural awareness and for public interest issues.

15. To open and run ad-films, Telefilms, Serials, Music Albums, Documentaries, Promotions, Grooming, Corporate Films, C.D. Films, Education and Children Films, Feature Films, Audio-Video, Music, Albums and Films Marking, T.V. And any other objectives to do any other act which is incidental to the aforesaid objectives and other objectives of charitable purpose, charitable nature and advancement of general public utility as may be defined or interpreted as charitable purpose under the provision of the Income Tax Act 1962 and other related laws for the time being in force. The Board of Trustees may amend and modify the objectives and include any other charitable purpose objectives time to time in accordance with the intention of the Trust. All the objectives and purposes of the Trust shall be of charitable purpose and charitable nature. All the charitable objectives and charitable purposes of the Trust shall be according to Income Tax Act and other Laws, Acts, Bye-laws, Rules of Government of India. Without limiting the generalities of the above mentioned objectives and clauses, to perform or carry out all such acts, deeds or things as may be necessary for the attainment of the main objectives contained herein.

J U D G M E N T RAJENDRA BABU, J. :

"Thou shall not prescribe, but treat". Does this commandment stand the test of legal scrutiny? This is the stark and simple question to be decided in this case. The long-winded facts of this case read as follows: That about 337 persons, including the appellants had completed the diploma course of Community Medical Service in duly recognized institutions in the State of West Bengal and were posted in different parts of the State by the Government of West Bengal. On October 15, 1980 vide Notification No. Health/MA/7076/5M-5/80 the Government of West Bengal made an amendment in the Statute of the State Medical Faculty by introducing Article 6F under Part B, which reads verbatim as under: "6F: Students who will undergo and complete the requisite course of studies in Medicine/Medical Science (as defined and detailed in the Schedule to this article and hereinafter called as the said Regulations for the Diploma course in Community Medical Services) in Medical Institutions, duly recognized by the State Medical Faculty of West Bengal, shall be admitted into examinations in the subjects laid down in the said regulations and the students passing the examinations shall be granted Diploma with the abbreviation "Dip. C.M.S", by the Governing body of the aforesaid Faculty. The Governing Body of the aforesaid Faculty shall also maintain a Register of such Diploma holders with a view to regulating, supervising and restricting their practice for the present." The objective of the said Notification, as detailed therein, is as follows:
I. Objectives:
i). To provide medical training to a group of personnel to man the Health Centers and Subsidiary Health Centers.
ii). Emphasis is to be given on comprehensive Health Care of the Community including promotive, preventive and curative aspects.
iii). A candidate after successfully completing the course of studies will act as a Team Leader of various categories of Field Workers.
iv). Training in curative medicines is to be imparted in such a way that after completion of training the trainees can treat common diseases among rural population including communicable diseases, malnutritional states, snake bite, insecticidal poisoning etc. Instructions on diseases requiring sophisticated treatment not practicable in Health Centers will be http://JUDIS.NIC.IN SUPREME COURT OF INDIA Page 2 of 5 restricted to the barest minimum. However, such candidates should learn to recognize sign and symptoms of more serious diseases requiring special treatment at referral hospitals (e.g., Sub-divisional or District Hospital) so that such patients may be sent early to these institutions.
v). The training in promotive and preventive aspect of Health Care including Family Planning and Child Care should be undertaken by actual participation in the field work under the supervision of their teachers along with the field workers.
vi). A substantial part of the training will be conducted in Health Centers where they will reside along with their teacher in each term of their course so that they are exposed to the field condition from the beginning of their course."
On 23/6/1987, the Government of West Bengal issued a Corrigendum and the Diploma that was earlier known as ’Diploma in Medicine for Community Physicians’ was rechristened as ’Diploma in Community Medical Service.’ Apprehending that the re-naming would have a detrimental effect on their rights, the appellants filed W.P. No.7052/89 in the Calcutta High Court. The said Writ Petition was disposed of by the learned Single Judge on the assurance given by the Government Pleader that the State was willing to award the ’Diploma in Community Medical Service’ to the successful candidates. It was also assured by the State, in the said petition that it would provide jobs to such candidates in accordance with the stated policy of the Government. The learned Single Judge of the High Court made it clear that the Diploma Holders will not have the right to private practice and that part of the order was not challenged by the appellants at all and entry in the register is only for the right to prescribe medicines and issue certificates.
Aggrieved by the order of the learned Single Judge, the appellants preferred an appeal before the Division Bench of Calcutta High Court. The Division Bench assured that the change in the nomenclature would not affect the Appellants right. The Division Bench reiterated that "the persons holding the Diploma and employed to man the Health Centers and Subsidiary Health Centers would be competent to treat common diseases among rural population including communicable disease, malnutritional states, snake bite, insecticidal poisoning etc".
